We understand that your aspirations, business model, or conditions may change. As a result, you may need to change one or more aspects of your liquor license.

Change of name

Changing the name of your venue can be completed through a simple application.

There are some restrictions on the new name and it must reflect the nature of your business. Limitations include:

  • a prohibited name
  • an objectionable or inappropriate name
  • a misleading name – for example the word 'bar' can be misleading if the business is actually a restaurant.

Timeframes

Fully completed applications will generally be determined within seven working days.

Applications that do not have all the required information will be delayed. We will contact you to request the missing details to progress the application quickly however we do rely on your speedy response to progress your application.

Change of boundaries

A change of boundaries modifies the footprint or size of the licensed areas of your premises.

Any changes to authorisations applying to your licence, for example: an extended trading authorisation (ETA), primary service authorisation (PSA), minors area authorisation - will not automatically extend to a new boundary. To include your existing authorisation within any boundary extension, you must lodge the appropriate application for that authorisation.

To illustrate the change in boundaries you’ll need to produce a plan that outlines the current licensed footprint in red and the proposed licensed area in a second colour. Be sure to include a key to show what the colours represent. Black and white plans will not be accepted.

Authorisations

You must also use a third colour to outline any existing authorisations on your licence, such as those for primary service, extended trading hours or minors’ areas.

Minors area

If you have a hotel licence and your proposed footprint extension will impact your Minors Area Authorisation (MAA) – you must also lodge an application to change your MAA.

Multiple premises for producer/wholesalers

To licence multiple producer/wholesaler venues, the venues need to either be:

  • in the same wine region
  • within 20km of each other outside of a wine region.

Checklist of what you need to lodge

Before lodging your application notify your local police and local council. Include this in your application to ensure the approval process isn’t delayed.

  • Ensure all attachments are in PDF format
  • A complete application form and fee – including notification of local police and council
  • A plan of the current licensed area and any authorisations
    • Outline the current licensed area in red, proposed boundary change in another colour, and authorisations in another colour. Include a key to show the meaning of eac h colour
  • community impact statement if the original licence application required a community impact statement, or a community impact statement would currently be required for an application of this type, and the change of boundaries application is for a substantial increase in the scale of the premises (greater than 50%); or if you’re applying for extended trading hours.

Timeframes

Change of boundaries applications take about eight weeks in total once all the required information has been submitted. This includes the Noticeboard period of 30 days.

  1. Once you lodge a complete application, it will be posted it on the Liquor and Gaming Application Noticeboard for a 30 day period for the community to make a submission on your application.
  2. Once the 30 day submission period ends, your application will be determined within four weeks.

Applications that do not have all the required information will be delayed. We will contact you to request the missing details, however we do rely on your speedy response with the missing information to progress your application.

Change of location

Liquor licences are attached to a premises, not a person. To relocate your business, you must apply to take your liquor licence with you. This is called a removal application.

We treat removal applications like applications for new liquor licences. The fee to remove a liquor licence is the same as the fee to apply for a new liquor licence of the same type.

Some things to remember

  • New, or reduced, trading hours may be imposed on your licence
  • A 6-hour closure period will be imposed on your licence
  • Any authorisations that apply to your licence at its current location like extended trading hours, will no longer apply
  • You will have an opportunity to respond before new conditions or trading hours are imposed on your licence.
  • To apply authorisations to your new premises, an application for the authorisations need to be lodged at the same time you apply to remove your licence.

Changing conditions

Your liquor license may have conditions that limit the operation of your business. You can apply to change your license conditions should your circumstances or business needs change.

Conditions

Conditions on your liquor license are imposed by either the Independent Liquor & Gaming Authority (ILGA) or the Secretary.

The source of each condition is noted next to the relevant condition on your liquor licence.

Change trading hours

By law, standard trading hours, except for take-away liquor, are:

  • 5am ​​- midnight Monday to Sunday

You are able to trade outside the standard trading period by  applying for an extended trading authorization PDF, 1078.96 KB.

Half hour live entertainment exemption

Live entertainment venues in Kings Cross may apply for an exemption to the lock out and last drinks conditions. This exemption will allow a later lock out time of 2am and last drinks of 3.30am.

Multi-occasion extended trading authorization (MOETA)

With a MOETA, premises outside the metropolitan area can trade until 3am on up to 12 occasions over a 12-month period.

A MOETA is a great option for regional venues that:

  • have standard trading hours
  • would like to occasionally trade past midnight.

You must notify L&GNSW at least six weeks in advance of any function date.

Cost

There is no application fee for this authorization, however it attracts an annual loading. Refer to the Liquor Fee Schedule for the trading hours loading.

Notification of function dates

Once you have been granted a multi-occasion extended trading authorization, you must use the online multi-occasion extended trading form to notify us of the dates you'll be extending your trading hours for functions.

You must notify us at least six weeks before each occasion. You can notify us earlier than six weeks and you can notify us of more than one date on the notification form.

Development consent

To change the current conditions or trading hours on your license, you must check if you also need to vary the development consent for your premises. It is up to you to lodge the relevant application with your local council.

Change of tenancy

In some circumstances you can lease or sub-lease your premises, or parts of your premises.

What you can lease or sub-lease with our approval:

  • part of your licensed premises with our approval
  • if your licensed premises is located in a shopping centre, you can lease or sub-lease a part of your premises where you normally sell or supply liquor – with our approval

What you cannot lease or sub-lease:

  • the right to sell liquor for consumption on the premises
  • the parts of your licensed premises where you normally sell liquor or operate gaming machines

Change of business type

We understand that your aspirations, business model, or business conditions may change. As a result, you may want to change the type of liquor licence you have or add additional business types to an existing on-premises licence.

On-Premises Licence

The licensee of an on-premises licence can apply to change the kind of business or activity carried out on the licensed premises. You may need to complete a Community Impact Statement (CIS) before applying.

Other Licence Types

A business that is looking to change from one licence type to a new liquor licence will need to apply to surrender the current licence and separately apply for a new licence. This involves two separate lodgements that should be done at the same time.

1. Permanently surrender your licence by submitting a surrender your liquor licence application.

As part of the application, you will need to enter:

  • Last date of trading for the venue. Enter a date 6 months ahead to allow for sufficient time for your new licence application to be assessed and an outcome decision made.
  • Enter a comment when indicating why you are proposing to surrender the licence and note that you are applying for a new licence.

2. Apply for a new liquor licence.

Manager approval and appointment

A corporation can hold a liquor license just as an individual can. The difference being that the corporate licensee must appoint an approved manager to the licensed premises.

There is a two-step process of approval and appointment where we accept all applications on behalf of the Independent Liquor & Gaming Authority Board (ILGA).

Step 1 - Approval of manager

We need to determine that the proposed approved manager is a fit and proper person for the role.

Once the proposed manager has been approved through the Step 1 process, a notification form for them to be appointed manager of the licensed premises held under a corporate license needs to be made.

Notify interest in liquor license business

Notify us if you:

  • have an interest in a liquor license business/licensed premises
  • would like your interest removed from a liquor license business.

Online application

  • If you wish to notify interest as a premises owner you will need to provide proof of ownership. This can be in the form of a title search and contract of sale or a rates notice.
  • If you wish to notify interest as a business owner you will need to provide proof of purchase of the business such as a contract of sale which includes the date of settlement.
  • If you are setting up a new business, you will need to provide a copy of an extract from the ABR register.
  • If a Trust has purchased the business you will need to provide a copy of the Trust Deed and a copy of the contract of sale including the settlement ate or a copy of an extract from the ABR register.

Change 6 hour closure period

The 6-hour closure period is a continuous block of 6 hours when you cannot sell or supply liquor on your licensed premises. The same 6-hour block applies to each day.

The 6-hour closure – usually from 4am to 10am – applies to any license or extended trading authorization.

You need to change the 6-hour closure period on your license if it conflicts with new trading hours you want to establish.

You can lodge applications to change your trading hours and applications to change your 6-hour closure period together. We'll assess them at the same time.

Development consent

To change the current conditions or trading hours on your licence, you must check if you also need to vary the development consent for your premises. It is up to you to lodge the relevant application with your local council.
