1. Terms and Conditions

1.1 Revenue NSW (RNSW) is part of the Department of Customer Service. Service NSW (SNSW) and RNSW are providing the Fines Service ("the Service") to enable customers to link their MyServiceNSW Account to the Revenue NSW Fines Service portal.

1.2 These terms and conditions (“Terms”), together with the privacy collection notice, apply to your use of the Service.

1.3 By using the Service, you agree to be bound by these Terms. Nothing in these Terms affects your obligations under any legislation, including the Fines Act 1996.

2. Changing these Terms

2.1 SNSW and RNSW may change these Terms from time to time by publishing them on this website. You agree that by doing this, SNSW and RNSW have provided you with sufficient notice of the change.

3. Definitions

3.1 In these Terms, unless the context otherwise requires:

  • Customer/s or You/Your means a person who is using the Service;
  • Service means the service described in clause 1.1 of these Terms.

4. Eligibility Criteria

4.1  You acknowledge and agree that you can only use the Service if:

       a. You have received a fine;
       b. You supply two (2) of the following to verify your identity:

                   i) Australian driver licence
                   ii) Medicare card
                   iii) Australian passport
                   iv) Australian birth certificate
                   v) Australian marriage certificate
                   vi) Australian change of name certificate
                   vii) Australian citizenship certificate
                   viii) Australian certificate of registration by descent
                   ix) ImmiCard
                   x) Australian travel visa

4.2 You may be required to enter a Fine Reference Number in your name (which can be found on the top right side of a Fine or Overdue Fine notice) to proceed with the linking of your MyServiceNSW Account to the Revenue NSW Fines Service portal.

5. Conditions

5.1  By using the Service, you agree that:

       a. SNSW can send Revenue NSW Fine and Overdue Fine notifications to you by email
           and/or SMS; and
       b. Revenue NSW fine notifications can be made available in the Notifications History of
           your MyServiceNSW Account and on the 'Manage my fines' page of the Revenue NSW
           website; and
       c. Your MyServiceNSW Account will be linked to the Revenue NSW Fines Service portal.

5.2 You consent to SNSW and RNSW disclosing to each other the personal information you provide in accordance with these Terms for the purposes of providing the Service and related purposes, including auditing or reporting on the Service.

5.3  All information provided by you in connection with signing up for and using the Service must be true and correct. Giving false or misleading information is a serious offence under the Crimes Act 1900 (NSW).

6. Exclusions from the Service

6.1 You acknowledge and agree that any fine not issued/addressed to You is excluded from the Service.

6.2 You acknowledge and agree that You cannot act on behalf of someone else. Authority to act is not part of the Service.

7. Discontinuance of Service

7.1 SNSW and RNSW reserve the right at any time and without notice to:

       a. suspend, discontinue or modify the Service in whole or part; and/or
       b. restrict access to the Service.

8. Liability

8.1 You acknowledge and agree that subject to any responsibilities implied by law and which cannot be excluded, SNSW and RNSW are not liable to you for any losses, expenses, damages, liabilities and claims whatsoever, whether direct, indirect or consequential, arising out of or referable to the use of the Service or its discontinuance, however caused (including your reliance on any inaccurate or incomplete information or data contained within or displayed by the Service), whether in contract, tort (including negligence), statute or otherwise. SNSW and RNSW’s liability for breach of a condition or warranty implied by law which cannot be excluded is limited to the extent possible to the resupply of the Service.

9. No warranty

9.1 SNSW and RNSW make no representation or warranty in relation to the information available on the Service, including without limitation:

       a. that the Service will be continuously available or free from any delay in operation or
           transmission, virus, communications failure, internet access difficulties or malfunction
           in hardware and software; and

       b. that SNSW and/or RNSW endorse any entity or internet site linked to its websites. By
           linking to a third-party website, SNSW and RNSW are not accepting responsibility for
           the content of that website or your use of it and make no warranty as to its suitability.
           Use of any third-party website is subject to the terms of that website.

10. Indemnity

10.1 You indemnify SNSW and RNSW in respect of any liability, loss, damage, cost or expense suffered or incurred by SNSW and RNSW arising from, or in connection with, your breach of these Terms.

11. Jurisdiction

11.1 These Terms and your use of the Service are governed by the laws of New South Wales, Australia. A reference to any legislation includes all delegated legislation made under it, including regulations and rules and amendments, consolidations or replacements of any of them.

12. General

12.1 A reference to an entity, whether statutory or not, which ceases to exist or whose powers or functions are transferred to another body is a reference to the body which replaces it or which substantially succeeds to its powers or functions. Specifying anything in the Terms after the words ‘include’ or ‘for example’ or a similar expression does not limit what else is included.

12.2 If any term in these Terms is prohibited, void, voidable, illegal or unenforceable for any reason whatsoever, then that part is severed from these Terms but without affecting the continued operation of the remaining Terms.

12.3 Clauses 8, 9 and 10 contain continuing obligations and will survive termination of these Terms.
