Important notice
- The NSW Digital Driver Licence (DDL) is the digital version of the NSW Driver Licence available through the Service NSW App.
- If you currently hold a DDL, you will be able to continue to use your DDL, and you may upgrade your DDL as a Verifiable Credential.
- Upgrading your DDL as a Verifiable Credential (VC) will mean that your Upgraded DDL will be compliant with ISO [18013-5] standard, which is a global standard for mobile driver licences designed to maximise data security and privacy.
- Upgrading your DDL as a VC will also mean that you will be able to use your DDL as a VC to verify your identity in some Participating Organisations. Some of these Participating Organisations will be Trusted Verifiers, which will mean that they will be identified as Trusted Verifiers in the SNSW App when you use your DDL as a VC in these Participating Organisations. If you use your VC with a Trusted Verifier, you will have the confidence that the Trusted Verifier is therefore bound by certain terms and conditions governing what information and data they are able to collect from you
- If you choose not to upgrade your DDL as a VC, you will continue to be able to use your DDL
Use of a DDL and the upgrade of the DDL as a Verifiable Credential is conditional upon the Terms and Conditions set out below. Please read the following Terms and Conditions carefully.
1. Scope
1.1. The following Terms and Conditions form an agreement between you and Service NSW (together, the Parties), including the Parties’ obligations in relation to the use of the DDL (including the upgraded version of the DDL as a Verifiable Credential), and relevant liabilities and indemnities.
1.2. These Terms and Conditions enter into force on 30 June 2026.
1.3. Service NSW may change these Terms and Conditions at any time as per clause 15 (Variation) of these Terms and Conditions.
2. Definitions and interpretation
2.1. In these Terms and Conditions, unless the context otherwise requires:
“Act” means Road Transport Act 2013.
“DDL” means Digital Driver Licence as defined in Part 3.7 of the Road Transport Act 2013 (NSW), and for the purposes of these Terms and Conditions, includes the existing DDL and upgraded version of the DDL as a Verifiable Credential [(Upgraded DDL)].
“Holder” means the individual or business who has been issued with a DDL and holds it in their Wallet.
“Multi-factor Authentication” means a security process in which you verify your identity and account activity. You will be prompted to authenticate via one of the following methods:
(a) by entering a secure code generated from the SNSW App.
(b) by entering a secure code which is sent via SMS to the mobile number associated with your MyServiceNSW Account; or
c) by tapping and approving a push notification on the SNSW App.
“MyServiceNSW Account” means the online service operated by Service NSW.
“NSW” means the State of New South Wales.
“NSW Driver Licence” means a physical plastic NSW driver licence card issued by Transport for NSW.
“NSW Photo Card” means a physical plastic Photo Card as defined in s. 3 of the Photo Card Act 2005 (NSW) and issued by Transport for NSW.
“Other Proof of Identity Documents” includes, but is not limited to, your NSW Driver Licence or NSW Photo Card.
“Participating Organisation” means an entity (for example, a Registered Club) accepting DDLs for the purposes of proving your identity, age or address.
“Police Officer” means a member of the NSW Police Force holding a position which is designated under the Police Act 1990 (NSW) as a position to be held by a police officer.
“Privacy Laws” means the laws governing privacy as applicable in New South Wales and the Commonwealth of Australia (including the Privacy and Personal Information Protection Act 1998 (NSW), Health Records and Information Privacy Act 2002 (NSW), and Privacy Act 1988 (Cth)), and includes any associated rules, codes of practice and guidelines made under those laws.
“RBT” means Random Breath Testing conducted by a Police Officer.
“SNSW App” means the Service NSW App.
“TfNSW” means Transport for NSW.
“Trusted Verifier” means a Verifier which is identified as a Trusted Verifier in the SNSW App.
[“Upgraded DDL” means the upgraded DDL as a Verifiable Credential.]
“Verifiable Credential” or “VC” means digital versions of physical credentials that are tamper-evident and can be cryptographically verified.
“Verifier” means an entity that requests verification of a credential shared with consent of the Holder via the SNSW Digital Wallet for the purposes of providing a service to that Holder.
“Wallet” means the digital wallet available on the SNSW App and installed on the Holder’s personal device.
“You” means a person who holds a DDL.
2.2. Interpretation
2.2.1. Unless the context requires otherwise, the singular includes the plural and vice versa, reference to a gender includes all genders, reference to “person” includes a natural person, company, body corporate or other form of legal entity, and reference to “including” and “includes” and “for example” is to read as if followed by “without limitation”.
2.2.2.2. If a word or phrase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning.
3. Acceptance of these Terms and Conditions
3.1. By creating, using or upgrading your DDL, you agree to abide by these Terms and Conditions.
3.2. Your DDL is accessed through your Wallet, so you must also abide by the MyServiceNSW Account Terms and Conditions and the SNSW App Terms and Conditions available within the SNSW App.
4. DDL Eligibility
4.1. You are eligible for a DDL (including, a DDL as a Verifiable Credential) if you:
- 4.1.1. have, or are able to obtain and maintain a MyServiceNSW Account;
- 4.1.2. have, or will link your MyServiceNSW Account to your NSW Driver Licence;
- 4.1.3. reside within NSW;
- 4.1.4. hold a NSW Driver Licence that is not expired and that is not subject to any enforcement action that prohibits your use of your NSW Driver Licence for driving purposes, including seizure or suspension of the NSW Driver Licence Card by a Police Officer.
- 4.1.5. have a unique phone number and email address which is not shared or accessible by others;
- 4.1.6. have Multi-factor Authentication enabled on your MyServiceNSW Account
- 4.1.7. are upgrading your DDL as a Verifiable Credential, you must also
- 4.1.7.1. consent to the verification of your identity documents with the issuer of your documents; and
- 4.1.7.2. have conducted a successful biometric facial verification.
- 4.1.7.3. You acknowledge that Service NSW may disable the DDL at any time and that you may be required to upgrade your DDL into a Verifiable Credential to continue to use the digital version of your NSW driver licence.
4.2. Service NSW reserves the right, at its sole discretion, to suspend or deactivate your DDL and terminate any access granted to you if:
- 4.2.1. You have breached these Terms and Conditions;
- 4.2.2. Your NSW Driver Licence is suspended, cancelled or suspected of being fraudulent; or
- 4.2.3. Service NSW considers that access to your DDL should otherwise be suspended or otherwise deactivated as a matter of law.
4.3. Any suspension or deactivation of your DDL by Service NSW in accordance with clause 4.3 does not necessarily affect your NSW Driver Licence Card issued by TfNSW.
5. How to upgrade your DDL into a Verifiable Credential
5.1. To upgrade your DDL to a Verifiable Credential, Service NSW will ask you to verify your identity. This process can be done by using or creating your NSW Digital ID, or by providing identity documents.
5.1.1. Proof of identity through NSW Digital ID
- If you use, or choose to create a NSW Digital ID you must comply with the NSW Digital ID Terms and Conditions.

Proof of identity through identity documents
- If you choose to upgrade your DDL to a VC by providing identity documents, the identity verification process will be conducted by Service NSW using the Document Verification Service (DVS).
- Service NSW will ask you to submit either a NSW Photo Card or NSW Driver Licence as one of the required identity documents.
- Service NSW will request your details from your chosen identity documents such as, but not limited to, your name, date of birth and document details (such as number, type and effective dates).

5.2. You acknowledge that giving false or misleading information to a public authority is an offence under s. 307B of the Crimes Act 1900 (NSW).
5.3. Biometric facial verification
5.3.1. Service NSW will also ask you to prove your identity through a biometric facial verification and liveness check in order to upgrade the DDL to a VC.
5.3.2. Service NSW will conduct this biometric facial verification through the SNSW App, where you will be asked to perform a scan of your face to verify your identity using a biometric facial verification system.
5.3.3. Service NSW will not retain any biometric information captured to complete this process. Service NSW will only retain a record of the outcome of the biometric facial verification process.

6. Use and misuse of the existing and upgraded DDL
6.1. You are responsible for any use or misuse of your DDL.
6.2. You understand and agree that at all times for as long as you hold a DDL:
- 6.2.1. You must not misuse your DDL or allow another person to use your DDL.
- 6.2.2. You must not use your DDL for any illegal or fraudulent activity.
- 6.2.3. You must not use any software (such as bots, scraper tools, artificial intelligence) to access, monitor, reproduce or copy your DDL.
- 6.2.4. You must keep your MyServiceNSW Account email and password secure at all times - do not share your password with anyone else.
- 6.2.5. You must ensure your phone is working and sufficiently charged so that your DDL can be viewed.
- 6.2.6 .You must ensure that you are using the latest version of the SNSW App and apply all updates to the SNSW App as they are made available for installation (e.g. software updates that enable a new functionality).
- 6.2.7. You must ensure your phone screen is not cracked, shattered or otherwise affected by any damage that may prevent your DDL from being viewed clearly when presented.
Service NSW recommends you continue to hold and carry your NSW Driver Licence Card at all times, including when you are driving outside of NSW, to ensure you are not inconvenienced.
6.3. Except if a vehicle is parked, you acknowledge that it is an offence for a driver to handle a mobile phone unless a Police Officer or other legally authorised person requires you to produce a driver licence, in which case you may handle your phone in order to show your DDL. It is important not to handle your phone until the Police Officer asks you.
6.4. You must immediately cease using your DDL upon:
- 6.4.1. Becoming disqualified from holding a driver licence;
- 6.4.2. Surrendering your NSW Driver Licence Card for any reason;
6.5. Having your DDL deleted or revoked by Service NSW, the NSW Police Force, or TfNSW for any reason, including misuse of the DDL or a breach of these Terms and Conditions.
7. Using your existing DDL
7.1. When you show your DDL to Participating Organisations or allow the QR Code on your DDL to be scanned, you are choosing to share your personal information with that third party and you may wish to first ask to see their privacy collection notice or privacy policy.
7.2. If you choose not to upgrade your DDL, you acknowledge that a you will not be able to verify if a Participating Organisation is a Trusted Verifier.
8. Using your upgraded DDL as a Verifiable Credential
8.1. When organisations ask you to verify your upgraded DDL, you will be shown a consent screen displaying the verifier status, being either a Trusted Verifier or other Verifier. The verifier may also request to collect information from your DDL as part of this process. More information about how to use your credentials safely is explained here [insert info sheet]
8.2. You acknowledge that if you choose to share your personal information with other Verifiers you are responsible for:
8.2.1. reviewing and assessing the status of any entity, including whether the entity is identified as a Trusted Verifier; and
8.2.2. assessing, accepting or declining to share your personal information.
8.3. You acknowledge that if a Verifier is not identified in the SNSW App as a Trusted Verifier, they are not a Trusted Verifier. Trusted Verifiers should only ask for the minimum information needed to provide you with a service. If you are unsure decline the request and ask to see to see their privacy policy.
9. Deactivation and Opt-Out
The DDL is stored only on your Wallet on your device. You can remove it from your device any time.
10. Privacy
10.1. Service NSW handles personal information about you in accordance with all applicable Privacy Laws, its Privacy Management Plan (available on its website), and in accordance with these Terms and Conditions.
10.2. How your personal information is handled when you create and use your DDL is explained in the Digital licences and credentials collection notice.
10.3. How your personal information is handled when you upgrade your DDL is explained in the NSW Digital Driver Licence Privacy Collection Notice.

11. Costs
Obtaining a DDL (and upgrading a DDL to a Verifiable Credential) is free, however you bear all other associated costs (including any data or Internet costs incurred in accessing your DDL).
12. Limitation of liability and indemnity
12.1. Service NSW is not liable in the event that you cannot view, access or produce a DDL including your DDL (Verifiable Credential), (for example network connectivity problems) or anyone refuses to accept your DDL, including your upgraded DDL (Verifiable Credential), as your NSW Driver Licence. Service NSW recommends that you carry your NSW Driver Licence Card as backup.
12.2. To the extent permitted by law, Service NSW makes no representation or warranty as to the legitimacy, conduct, security practices or compliance of any Verifier (including Trusted Verifiers) and is not responsible for, and has no control over, the collection, use, disclosure, storage or handling of your information shared with any Verifier.
12.3. Except for any liability that cannot be excluded by law, Service NSW (including its officers, employees and agents) will not be liable for any loss or damage whatsoever that is suffered or sustained (including, but not limited to, indirect or consequential loss) or for any death, illness, personal injury, financial loss or property damage suffered or sustained (even caused by negligence), as a result of, or in any way connected with:
- 12.3.1. your use of DDL, including your decision to share your information with third-parties; and
- 12.3.2. your failure to assess or correctly assess whether a Verifier is a Trusted Verifier.
12.4. To the extent permitted by law, you agree to release, fully indemnify and keep fully indemnified, Service NSW and TfNSW (including their officers, employees and agents) from and against all liability, cost, loss, damage, expense, claim or other right of action arising out of, or in connection with, your use of a DDL, including the unavailability of the DDL or the refusal of a third person to accept your DDL or any of your interactions with Verifiers.

14. General
You are responsible for obtaining your own independent legal and financial advice regarding these Terms and Conditions.
15. Variation
15.1. Service NSW reserves the right to amend, vary, delete or supplement these Terms and Conditions at any time. If these Terms and Conditions change, you will be asked to confirm your agreement to those changes the next time you access your DDL.
15.2. These Terms and Conditions, as varied, deleted or supplemented from time to time, apply to any future version of, or update to, the DDL software.
16. Waiver
Failure by Service NSW to enforce any of its rights at any stage does not constitute a waiver of those rights.
17. Severability
If any term in these Terms and Conditions is, becomes or is declared illegal, invalid or unenforceable for any reason whatsoever, it shall be severed from these Terms and Conditions and the remaining Terms and Conditions shall continue in full force.
18. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws in NSW. The parties submit to the exclusive jurisdiction of the Courts of NSW and any Court competent to hear appeals from those Courts.
19. Survival
Any and all provisions or obligations contained in these Terms and Conditions which, by their nature or effect, are required or intended to be observed, kept or performed after termination of these Terms and Conditions will survive the termination of these Terms and Conditions and remain binding upon and for the benefit of the relevant persons.
