Why your personal information is being collected

The Building Commission NSW (as part of the Department of Customer Service) have partnered with Service NSW to collect certain applications being made under the Home Building Act 1989. To apply for a company or partnership contractor licence or owner-builder permit online you are required to use or create a MyServiceNSW Account.

Personal information is being collected as part of your application for a licence or permit to assess your eligibility to hold the relevant licence or permit. The information you provide will also be used for ongoing management and compliance related to the relevant licence or permit.

How your information will be used and disclosed

The Building Commission NSW  and Service NSW share the information provided in your application between the agencies for the purposes outlined in this notice.

Your personal information is used for the primary purpose that it was collected for, or a directly related secondary purpose. This includes to:

  • process your application under the Home Building Act 1989
  • Verify your identity with the Document Verification Service (DVS) with your consent
  • contact you about your application, including to request additional information from you or respond to your enquiry
  • confirm your details if you make any subsequent applications in relation to any licence or authority issued by Building Commission NSW. This includes to administer update our customer database, including to send you information that we consider important such as reminders to renew licences.
  • record information on a public register, as required by legislation which will be published online on the Verify NSW website.
  • manage your eligibility to hold the licence or permit, and to undertake compliance programs.

Information in your application may be disclosed to:

  • Other NSW government agencies (including the NSW Police Force), or other States, Territories and/or the Commonwealth for the purpose of assessing your application and for compliance purpose.
  • With any organisation or individual in order to verify the documents or other evidence that you provided making your application.

Service NSW uses the DVS provided by the Attorney-General’s Department to check the validity of your documents against the records of Australian Government and state and territory government agencies that issue certain documents, or with Services Australia for Commonwealth concession cards.

Please contact us if you do not consent to verify your identity documents through the DVS. You may have the option to verify your identity documents in an alternative way. However, if you refuse to verify your identity we may not be able to assist you to complete the transaction.   

Whether you are required by law to provide us with this information

You are required to provide certain information under the Home Building Act 1989. If you do not provide all the information requested your application may be delayed or refused.
