Overview

1. These Terms and Conditions apply to the delivery of the “Services” by Service NSW to you as a person using the Services. 

2. The Terms and Conditions contained in this document, together with the Privacy Collection Notice, and any conditions, notices and disclaimers on the Service NSW website (the “Terms”), govern your access and use of the Services, and describe your rights and responsibilities as a user of Service NSW services.

3. Your access to and use of the Services is conditional upon your acceptance and compliance with the Terms.

4. The “Services” mean the transactions Service NSW undertakes to issue you with an International Driver Licence (IDP), on behalf of the National Roads and Motoring Association (NRMA).

5. Should you object to any of the Terms or any amendments, your only recourse is to immediately cease accessing and using the Services.

6. Please note a range of services provided by Service NSW have their own Terms and Conditions.

Variation

7. Service NSW reserves the right to amend, vary, delete or supplement these Terms and Conditions at any time.

8. These Terms and Conditions, as amended, varied, deleted or supplemented from time to time, apply to any future version of, or update to, the Services.

Lawful Purposes

9. You must use the Services only for lawful purposes and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of the Services by any third party. This includes conduct which is unlawful, or which may harass or cause distress or inconvenience to any person, the spread of obscene or offensive content or disruption to service.

10. Whilst using the Services, you must not distribute any unlawful, defamatory, obscene, offensive or scandalous material, or any material that constitutes or encourages conduct that would contravene any law.

Your Responsibility

11. You shall be a qualified person to access the services. 

12. A “qualified person” means a person who is over 18 years of age and holds a full (unrestricted) or provisional Australian driver licence.

13. You are responsible for decisions relating to and for the use of the Services. 

14. You are responsible for misuse of the Services, whether or not such use has been authorised by you. 

15. You must advise Service NSW immediately if you suspect that the security of your information may have been compromised. 

16. The information you supply to Service NSW must be complete and accurate. 

17. You acknowledge that you will not supply incomplete, inaccurate or false information. 

18. You must not conduct unauthorised action, or otherwise misuse the Services.

19. Giving false or misleading information is a serious offence and may result in prosecution and civil or criminal penalties.

Suspension or Termination

20. If you supply incomplete, inaccurate or false information, perform an unauthorised action or misuse the services, Service NSW may refuse to issue you with another IDP. 

21. If you violate any Terms your right to access and use the Services automatically terminates. 

22. The Services may be suspended or terminated at any time. 

Transactions and Payments

23. You will be bound by the actions with respect to the IDP transaction we carry out on your behalf and will also be bound by the Australian Automobile Association (AAA) IDP Terms & Conditions and Privacy Policy. 

24. We urge you to familiarise yourself with the AAA IDP Terms & Conditions and Privacy Policy.

25. A record of the IDP transaction is generated in the Service NSW system and a tax invoice is issued for the payment.

Limitation of Liability

26. To the extent permitted by law, Service NSW (including their officers, employees and agents) will not be liable for any direct, indirect, incidental, special or consequential loss or damage or for any death, illness, personal injury, financial loss or property damage however caused (including by negligence) which may be suffered or incurred by a business, organisation or any person arising directly or indirectly out of or in any way connected with your access and use of the Services.

Indemnity

27. You agree to indemnify and keep indemnified Service NSW (including their officers, employees and agents) from and against any liability or loss (including reasonable legal costs and expenses), which may be suffered or incurred by any of those indemnified by reason of or in connection with your access and use of the Services. 

Privacy Collection Notice

28. The use of the Services is conditional on providing personal information to Service NSW, NRMA, and AAA. 

29. By using the Services, you consent to the retention, use and disclosure of your personal information by Service NSW for the purposes of completing the IDP transaction.

30. Service NSW is obliged to protect the privacy of your personal information. We do this by handling personal information in a responsible manner and in accordance with the Privacy and Personal Information Protection Act 1998. 

31. Please read the Privacy Collection Notice for more information about how your personal information will be handled by Service NSW.

General

32. If any of these Terms are held to be invalid, unenforceable or illegal for any reason, the remaining Terms will continue to be valid and enforceable.

33. The Terms are governed by and are to be construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

34. Clauses 26 and 27 contain continuing obligations and will survive termination of these Terms and Conditions. 

Disclaimer

35. The Services are limited to issuing IDPs on behalf of NRMA. Any enquiries relating to IDPs should be directed to NRMA. We frequently update our content, so please visit our website to ensure you have the latest advice. Our website contains links to other government sites and allows you to complete transactions of other NSW Government agencies.

36. With regard to this information and IDP transaction, NRMA may have their own protocols, terms and conditions and disclaimers. We urge you to familiarise yourself with these.

Complaints Handling and Feedback

37. Service NSW welcomes all forms of feedback, including complaints on its services. We view effective complaint management as part of our commitment to improving service provisions and re-occurring problems.
