NSW Trustee & Guardian supports the people of NSW in planning for their future legal, health and financial decisions. The agency can also be appointed as a person's financial manager and/or guardian by a court or tribunal.

They can help with the following services.

  • Wills – A Will is a legal document that sets out your wishes regarding the distribution of your assets after you die. The drafting of a Will is a specialised and often complex task, and it's advisable to have it professionally drafted to ensure it is in accordance with legal requirements. NSW Trustee & Guardian is NSW's largest Will maker with more than 100 years' experience.
  • Power of Attorney – A Power of Attorney is a legal document whereby you appoint a person or an organisation (your attorney) to manage your financial affairs on your behalf. An attorney can act for you in situations such as extended travel, or for a time when you are no longer able to manage your own affairs. When NSW Trustee & Guardian makes your Power of Attorney document, you can appoint them as your attorney, or someone of your own choosing.
  • Enduring Guardianship – An Enduring Guardian is a person you appoint to make lifestyle, health and medical decisions for you in case you lose the capacity to make those decisions for yourself. If you don't have an Enduring Guardian, one will be appointed for you by the NSW Civil and Administrative Tribunal (NCAT).
  • Will Safe – Will Safe provides safe storage for important planning ahead documents such as Wills, Powers of Attorney and Enduring Guardianship appointments. Over half a million people in NSW have their Will stored with NSW Trustee & Guardian.
  • Trusts – A trust is an arrangement where a person or organisation administers and manages the assets of the trust beneficiary. Trusts are created for a number of reasons such as to provide on-going support for a beneficiary under a Will, to provide tax effective estate planning, or to benefit a charity. NSW Trustee & Guardian currently administers over 9000 trusts and can advise you on the type of trust to suit your particular needs and circumstances.
  • Estate administration – An executor is the person or organisation who administers your estate, within the terms of your Will, when you die. Estate administration is a complex task, and NSW Trustee & Guardian offers professional and independent services with the expertise of accountants, trust managers, taxation and investment specialists on staff. They have been administering estates in NSW for more than a century.
  • Financial management – NSW Trustee & Guardian can be appointed by a court or tribunal to provide direct financial management services for people who have a disability that affects their capacity to make decisions. It also provides authorisation and direction to private managers who've been appointed by a court or tribunal.
