If your business or not-for-profit organisation is not eligible for the 2021 COVID-19 business grant, COVID-19 micro-business grant or JobSaver payment, you may still be able to access financial support by submitting your details to the COVID-19 business hardship review panel.
Businesses that do not meet the eligibility criteria for the COVID-19 business support schemes, and businesses that have had their applications refused, may now be eligible to apply to the panel for special consideration. Businesses must be able to demonstrate financial hardship as a result of NSW public health orders.

The COVID-19 business support hardship review panel includes members from Revenue NSW, NSW Treasury and Service NSW. The panel will review applications on a case-by-case basis. Decisions are final and cannot be appealed.
To be eligible to apply to the hardship review panel, you must demonstrate that you:
- do not meet the eligibility criteria for a 2021 COVID-19 business grant, COVID-19 micro-business grant or JobSaver payment, or
- have had your applications for COVID-19 business support refused because you cannot demonstrate the required decline in aggregated turnover or do not meet the minimum annual turnover requirements, and
- are experiencing financial hardship as a result of NSW public health orders.
To prove financial hardship, you must demonstrate that:
- your business is at imminent risk of closure,
- you are unable to pay for operating costs, such as rent or worker-related expenses, and/or
- you will be forced to reduce employee headcount.
Non-employing businesses may also need to demonstrate that they are unable to provide themselves or their immediate families a modest standard of living.
You must also demonstrate that:
- you have not engaged in excessive and non-essential expenditure
- your decline in revenue is due to the impact of NSW public health orders, rather than the result of normal business operations
- it is not practical to rearrange finances or draw upon non-essential assets to continue to operate.
You are not eligible to apply to the hardship review panel if you:
- have an application for the COVID-19 business grant, COVID-19 micro-business grant or JobSaver payment that is currently being assessed by Service NSW
- have been found to be eligible for the COVID-19 business grant, COVID-19 micro-business grant or JobSaver payment, but are seeking to reapply for a different amount based on changes to eligibility criteria
- have previously applied to Service NSW and wish to withdraw and resubmit your application based on changes to eligibility criteria
- have previously submitted an application that has been identified by Service NSW as potentially fraudulent or where there are disputes about previous debts owed
- are a non-employing business that received the Commonwealth Disaster Payment but wish to receive COVID-19 business support for the same period.
What you need
If you have applied for the 2021 COVID-19 business grant, COVID-19 micro-business grant or JobSaver payment and your application was refused, the hardship review panel will use the evidence originally submitted to support your application to consider your case.
When the panel reviews your application, it may ask you for more documentation to make its assessment. This may include:
- evidence of business expenses (for example, bills for utilities, rent or wages)
- evidence of revenue (including decline in revenue)
- evidence of the impact that NSW public health orders have had on employee headcount
- copies of your business’s recent filings with the Australian Taxation Office or other government agencies (with your tax file number redacted)
- copies of lease agreements or other fixed cost contracts your business has entered
- a statement from an independent party about the impact your business has in the community, in terms of employment and delivery of goods and services
- the business owner’s insights about the experience of financial hardship
- a letter from the business’s qualified accountant, registered tax agent or registered BAS agent
- any other relevant documentation.
