Introduction

You need a trade promotion gaming authority if you'd like run a free-entry competition with a total prize value of more than $10,000 to promote your business.

You can apply and pay online for a 1-year, 3-year or 5-year authority. The authority allows you to run trade promotion gaming activities during the valid period, provided you notify Fair Trading before each promotion.

Notify Fair Trading

When you have a valid authority you must notify NSW Fair Trading at least 10 business days before the start date of each promotion that has a total prize value of more than $10,000.

Eligibility

The gaming activity must:

  • be free to enter (entry by purchasing goods or services at their normal retail value is allowed)
  • have a total prize value of more than $10,000
  • be a competition based on chance (such as a sweep, giveaway or contest) not skill
  • genuinely promote the goods or services of your business
  • take place on the date nominated.

Note: There is no maximum prize value for trade promotions. The prize must not be a prohibited prize

Participants

Participants in the trade promotion must not be:

  • conducting the trade promotion including determining the winners
  • involved in the management of any business benefiting from the promotion.

Children can participate unless the rules of the trade promotion have an age limit.

What you need

  • details of the promotion
  • an email address for the promotion licensee or contact person
  • written consent from an authorised person in the business if you are conducting a trade promotion on behalf of a business
  • your fee payment.

  1. Check the eligibility requirements.
  2. Get the documents and information you need ready.
  3. Select the 'Apply online' button.
  4. Follow the prompts to complete your application and pay the application fee.
