Introduction

If you wish to make an enquiry about the will of a deceased person for family tree research, or for personal reasons, you can do this through the NSW Trustee and Guardian. They are NSW's largest will maker and their extensive database can be searched to confirm if they hold the will of a deceased person.

Eligibility

People who can request to inspect a will include:

  • those who are referred to in the will or an earlier will
  • certain relatives
  • those who would be entitled to the estate if the will is not valid and the estate is distributed according to the NSW intestacy laws
  • those with a claim against the estate.

What you need

  • the deceased's name, address and date of birth
  • the deceased's date of death and death certificate
  • your name, phone number and email address
  • your relationship to the deceased.

How to enquire

  1. Select the 'Check online' button.
  2. Complete the online form.
  3. Submit.

If a will cannot be located, an application needs to be made to the Supreme Court for ‘Letters of Administration’ – a document providing the court’s formal approval for someone to administer the estate of the deceased.
