Most full-time, part-time or casual employees in NSW are entitled to long service leave. If you've been with the same employer for 10 years, you're entitled to 2 months (8.67 weeks) paid leave. This leave is paid at your ordinary gross weekly wage.

If you have completed 5 years (but less than 10 years) of service you may be entitled to a long service pro-rata payment if you:

  • resign as a result of illness, incapacity, domestic or other urgent need, or
  • are dismissed for any reason except serious and wilful misconduct, or
  • die.
