- Service NSW is testing the NSW Digital ID to enable and facilitate the use of digital identities when dealing with government, without needing to show or provide copies of identity documents.
- The NSW Digital ID is a reusable, voluntary, digital, government issued evidence of identity proofed to an Identity Proofing Level 3. Identity Proofing Level 3 provides a high level of confidence in the claimed identity.
- As the NSW Digital ID is a new technology, Service NSW is currently testing this capability through a Pilot which will trial the customer journey to create, use and reuse a NSW Digital ID (Pilot) for a limited number of transactions.
- Service NSW stores the NSW Digital ID, and you can access the NSW Digital ID through your MyServiceNSW Account. This means that you are in control of your NSW Digital ID which can be deactivated at any time.
- Your NSW Digital ID is not intended to replace your existing identity documents, however additional functionality, such as selective disclosure of information will be available as part of the NSW Digital ID features.
- Participation in the Pilot is voluntary but is conditional upon agreement to the Terms and Conditions set out below. Please read these Terms and Conditions carefully.
Scope
1.1 The following Terms and Conditions form an agreement between you and Service NSW (together, the Parties), including the Parties’ obligations in relation to the Pilot, and relevant liabilities and indemnities.
1.2 These Terms and Conditions enter into force on [15 December 2025], and may be amended from time to time as per clause 15 (Variation) of these Terms and Conditions.
Definitions and Interpretation
2.1 In these Terms and Conditions, unless the context otherwise requires:
“Digital NSW Driver Licence” means a Digital Driver Licence as defined in Part 3.7 of the Road Transport Act 2013 (NSW) or a physical Driver Licence card issued by Transport for NSW.
“Multi-factor Authentication” or “MFA” means a security process in which you verify your identity and account activity. You will be prompted to authenticate via one of the following methods:
- by entering a secure code which is sent via SMS to the mobile number associated with your MyServiceNSW Account; or
- by tapping and approving a push notification on the SNSW App; or
- by entering a secure code generated from the SNSW App.
“MyServiceNSW Account” means the online service operated by Service NSW.
“NSW Driver Licence Card” means a physical plastic driver licence card issued by Transport for NSW.
“NSW Photo Card” means a Photo Card as defined in s. 3 of the Photo Card Act 2005 and issued by Transport for NSW.
“NSW” means the State of New South Wales.
“Other Proof of Identity Documents” includes, but is not limited to, your Digital NSW Driver Licence, NSW Driver Licence Card or NSW Photo Card.
“Pilot” means the test of the customer journey to create, use and reuse the NSW Digital ID either as a standalone function or as part of a transaction.
“SNSW App” means the Service NSW App.“You” means the holder of the NSW Digital ID.
Acceptance of these Terms and Conditions
3.1. By participating in the Pilot, you agree to these Terms and Conditions, and you must abide by these Terms and Conditions while participating in the Pilot.
3.2. You must also abide by the MyServiceNSW Account Terms and Conditions when creating and using a NSW Digital ID and if the NSW Digital ID is accessed through the SNSW App, you must also abide by the Service NSW App Terms and Conditions available within the SNSW App.
Eligibility
4.1 You are eligible to apply for a NSW Digital ID if you:
- 4.1.1 Are at least 16 years of age;
- 4.1.2 Ordinarily reside in NSW;
- 4.1.3 Have or are able to obtain a single MyServiceNSW Account;
- 4.1.4 Have a unique phone number and email address which is not shared or accessible by others;
- 4.1.5 Have Multi-factor Authentication enabled on your MyServiceNSW Account;
- 4.1.6 Consent to the verification of your identity documents with the issuer of your documents;
- 4.1.7 Have conducted a successful biometric facial verification; and
- 4.1.8 Consent to an Australian Death Check.
4.2 You acknowledge that your NSW Digital ID may only be valid for the Pilot, and for as long as the Other Proof of Identity Documents used to set up your NSW Digital ID remain valid.
4.3 You acknowledge that you may need to re-apply for a NSW Digital ID in certain situations, including (but not limited to) when your Other Proof of Identity Documents need to be reverified or if Service NSW suspends or deactivates your NSW Digital ID.
4.4 You acknowledge that if you have used your NSW Digital ID as part of a transaction and your NSW Digital ID is subsequently suspended or deactivated, it may affect whether or not you remain eligible to apply or complete any relevant transaction.
4.5 In addition to its rights under clause 11 (Suspension or Termination of the Pilot), Service NSW reserves the right, at its sole discretion, to suspend or deactivate your NSW Digital ID and terminate any access granted to you if:
- 4.5.1 You have breached these Terms and Conditions;
- 4.5.2 Any of the identity documents used to set up your NSW Digital ID expire, are suspended, are cancelled, or suspected of being fraudulent; or
- 4.5.3 It considers that access to your NSW Digital ID should otherwise be suspended or deactivated as a matter of law, or otherwise at any time during the Pilot for any reason.
Privacy
5.1 Service NSW handles personal information about you in accordance with all applicable privacy legislation (including the Privacy and Personal Information Protection Act 1998), its privacy management plan (available on its website), and in accordance with these Terms and Conditions.
5.2 How your personal information is handled when you create, use, and reuse a NSW Digital ID is explained in the NSW Digital Identity Pilot – Privacy collection notice.
5.3 How your personal information is handled when you use your MyServiceNSW Account is explained in the MyServiceNSW Account Privacy Collection Notice.
Creation of a NSW Digital ID
6.1 Verification of Identity Documents
- 6.1.1 Service NSW will ask you to prove your identity in order to issue a NSW Digital ID. The identification verification process is conducted by Service NSW and you will be asked to submit identity document/s such as, but not limited to, your NSW Driver Licence or NSW Photo Card. Service NSW will request your details from your chosen identity documents such as but not limited to, your name, date of birth, and document details (such as number, type and effective dates). Service NSW will also request other details specific to this Pilot.
- 6.1.2 How your personal information is handled when you prove your identity is explained in the Face verification and identity checks – Privacy collection notice and NSW Digital Identity Pilot – Privacy collection notice.
- 6.1.3 You must submit your own identity documents and not use anyone else’s. The information you supply when setting up your NSW Digital ID via your MyServiceNSW Account must be complete and accurate.
- 6.1.4 You acknowledge that if you supply incomplete, inaccurate or false information, or use your NSW Digital ID to perform (or attempt to perform) an unauthorised action, or otherwise misuse your NSW Digital ID, Service NSW may suspend, revoke or terminate access to your NSW Digital ID.
- 6.1.5 You acknowledge that you must update your NSW Digital ID if your name has changed.
- 6.1.6 You also acknowledge that giving false or misleading information to a public authority is an offence under s. 307B of the Crimes Act 1900 (NSW).
6.2 Biometric facial verification
- 6.2.1 Service NSW will capture biometric information from you by scanning your face to verify your identity using a biometric face verification system. Service NSW will not retain biometric information captured to complete this process. We only retain a record of the outcome of the face verification process.
- 6.2.2 How your personal information is handled when doing a biometric facial verification is explained in the MyServiceNSW Account Privacy Collection Notice and NSW Digital Identity Pilot Privacy Collection Notice.
6.3 Australian Death Check
- 6.3.1 Service NSW will ask for your name and date of birth to be completed in order for Service NSW to conduct an Australian Death Check, to ensure your identity is not registered with the Australia Death Check service.

Notification and Messages
By participating in the Pilot, you agree to receive emails from Service NSW about the NSW Digital ID and the Pilot, including to provide feedback as part of a survey, notwithstanding any other directions you may give or have given Service NSW about subscribing to notifications.
Use and Misuse of the NSW Digital ID
8.1 You are responsible for any use or misuse of your NSW Digital ID.
- 8.2 You understand and agree that at all times during the Pilot:
- 8.2.1 You must not use your NSW Digital ID for any illegal or fraudulent activity.
- 8.2.2 You must not share details of your NSW Digital ID outside of the Pilot with anyone or allow someone else to log in to your MyServiceNSW account.
- 8.2.3 You must not use any software (like bots, scraper tools) to access, monitor or copy your NSW Digital ID .
- 8.2.4 You must keep your MyServiceNSW Account email and password secure at all times — do not share your password with anyone else.
- 8.2.5 If accessing the NSW Digital ID through your mobile device, you must ensure your device is working and sufficiently charged so that your NSW Digital ID can be viewed.
- 8.2.6 You must ensure that Multi-factor Authentication is turned on within your MyServiceNSW Account before you create a NSW Digital ID and that it remains enabled for the duration of the Pilot, otherwise you will be unable to create, use, or reuse your NSW Digital ID.
8.3 Service NSW may undertake fraud prevention and detection activities to ensure that you are not using the NSW Digital ID for illegal, fraudulent or unauthorised activities. Misuse of your NSW Digital ID may result in Service NSW suspending or deactivating your NSW Digital ID. Where illegal or fraudulent activity is suspected, Service NSW may also notify NSW Police and other authorities as permitted by law.
8.4 Transport for NSW may also undertake fraud prevention and detection activities in relation to the NSW Driver Licence Card and/or NSW Photo Card, if these documents were used to create your NSW Digital ID, and provide details of fraud or identity-related issues to Service NSW.
8.5 Contact Service NSW immediately if you suspect that the security of your NSW Digital ID may have been compromised, or if you see any abnormal activity. For example, if you are unable to access your NSW Digital ID or the details of your NSW Digital ID are not your own and you have checked that you are using the correct email and password.
8.6 You should change your MyServiceNSW Account password immediately if you think someone else has become aware of it.
Deactivation and Opt-Out
9.1 Your NSW Digital ID is stored only on your MyServiceNSW Account. You can remove it from your MyServiceNSW Account any time however doing so during the Pilot will automatically remove you as a Pilot participant for the remainder of the Pilot period.
9.2 At the conclusion of the Pilot your NSW Digital ID may become unavailable and you may not be able to access or use it. You may be required to remove the NSW Digital ID from your MyServiceNSW Account however this will not impact the validity of your existing physical credentials.
Term
The term of the Pilot will be at the discretion of Service NSW.
Suspension or Termination of the Pilot
Notwithstanding any other provision in these Terms and Conditions, Service NSW may, in its absolute and sole discretion, suspend or terminate the Pilot at any time, for any reason, which may result in the suspension or deactivation of your NSW Digital ID.
Cost
Creating and using a NSW Digital ID is free, however you bear all other associated costs (including any data or internet costs incurred in accessing your NSW Digital ID) for the purposes of this Pilot.
Limitation of Liability and Indemnities
13.1 Service NSW is not liable in the event that you cannot view your NSW Digital ID (for example network connectivity problems) or if you attempt to use your NSW Digital ID as proof of identity and it is not accepted. Service NSW recommends that you carry Other Proof of Identity Documents as backup.
13.2 Except for any liability that cannot be excluded by law, Service NSW (including its officers, employees and agents) will not be liable for any loss or damage whatsoever that is suffered or sustained (including, but not limited to, indirect or consequential loss) or for any death, illness, personal injury, financial loss or property damage suffered or sustained (even caused by negligence), as a result of, or in any way connected with, using or carrying the NSW Digital ID.
13.3 To the extent permitted by law, you agree to release, fully indemnify and keep fully indemnified, Service NSW (including their officers, employees and agents) from and against all liability, cost, loss, damage, expense, claim or other right of action arising out of, or in connection with, your use of the NSW Digital ID including the unavailability of the NSW Digital ID or the refusal of a third person to accept your NSW Digital ID.

General

Variation
16.1 Service NSW reserves the right to amend, vary, delete or supplement these Terms and Conditions at any time. If these Terms and Conditions change, you will be asked to confirm your agreement to those changes the next time you access your NSW Digital ID .
16.2 You agree to receive any notifications in relation to any amendment of these Terms and Conditions.
16.3 These Terms and Conditions, as varied, deleted or supplemented from time to time, apply to any future version of, or update to, the NSW Digital ID .
Waiver
Failure by Service NSW to enforce any of its rights at any stage does not constitute a waiver of those rights.
Severability
If any term in these Terms and Conditions is, becomes or is declared illegal, invalid or unenforceable for any reason whatsoever, it will be severed from these Terms and Conditions and the remaining Terms and Conditions continue in full force.
Governing Law
These Terms and Conditions will be governed by and interpreted in accordance with the laws in NSW. The parties submit to the exclusive jurisdiction of the Courts of NSW and any Court competent to hear appeals from those Courts.
Survival
Any and all provisions or obligations contained in these Terms and Conditions which, by their nature or effect, are required or intended to be observed, kept or performed after termination of these Terms and Conditions will survive the termination of these Terms and Conditions and remain binding upon and for the benefit of the relevant persons.
