Introduction

Under the design and building practitioners scheme a body corporate is a corporation or an incorporated association. It is not an owners' corporation, trust or partnership.

Building practitioner – body corporate

When you apply to register as a building practitioner – body corporate you must nominate an individual registered in the relevant class to make building compliance declarations and lodge documents on behalf of the company in the NSW Planning Portal for regulated buildings:

  • class 2, 3, or 9c buildings
  • buildings with a class 2, 3, or 9c part.

Licence restrictions for building categories

If a body corporate does not hold a current licence issued under the Home Building Act 1989 in the category of Building it will be restricted to making a building compliance declaration for class 3 and 9c buildings only.

 Building practitioner – individual

An individual building practitioner can be the nominee for more than one registered body corporate at a time provided you can manage the workload responsibly.

Your registration

You can register as a building practitioner – body corporate for 1, 3 or 5 years. Registration application fees apply.

If your application is approved by Building Commission NSW you will receive a certificate of registration by email.

Eligibility

You must be the director of a body corporate to apply for this registration.

To be eligible to apply each member of the body corporate must:

  • be aged 18 or over
  • be a director of the body corporate
  • have a current National Police Check:
    • completed 4 months or less before you submit your application
    • name and date of birth check only.

You cannot register if you are an undischarged bankrupt.

What you need

To apply for building practitioner – body corporate registration you need:

  • a MyServiceNSW Account
    • if you do not have an account you can create one when you start your application
    • you may need details from 2 identity documents (such as Australian driver licence, Medicare card, passport)

  • a current ASIC extract listing all directors of the body corporate
  • for each director of the body corporate other than the applicant, a signed and completed declaration form – PDF
  • National Police Check certificates for each director
  • the body corporate details
  • contact details for each director of the body corporate
  • your contact details as the applicant
  • the registration application fee.

How to apply

  1. Check the eligibility criteria.
  2. Gather the director declaration forms and other documents such as National Police Check certificates for all directors.
  3. Select the ‘Apply online’ button.
    Note: You can save and resume your application within 60 days. After 60 days any details you entered will be deleted.
  4. Log in or create your MyServiceNSW Account.
  5. Follow the prompts to:
    • complete your application and
    • pay the fee.

What happens next

When you apply:

  • your application will be assessed by Building Commission NSW on set criteria for:
    • qualifications
    • experience, skills and knowledge (if required)
    • fitness and propriety
  • if Building Commission NSW contacts you to ask for more information the processing time may increase
  • you will be notified about the result of your application when the assessment is completed.
